Wycoff Co., Inc. v. Public Service Commission of Utah
195 F.2d 252 · Court of Appeals for the Tenth Circuit · 1952
Facts
Wycoff Company, an interstate motor carrier, transported motion picture films from national distributors to Salt Lake City exchanges, and then to local exhibitors within Utah. The Utah Public Service Commission sought to regulate the intrastate portion of this transport, but Wycoff argued all its activities were interstate. The trial court sided with the Utah PSC, finding the in-state movements to be intrastate commerce.
Procedural history
Wycoff Company, Inc. initiated a declaratory judgment action in the United States District Court for the District of Utah, seeking a declaration that all its activities were interstate and an injunction against the State Commission. The trial court concluded that the transportation within Utah was intrastate and subject to the State Commission's jurisdiction, denying Wycoff relief. Wycoff appealed this decision to the Circuit Court, which subsequently reversed the trial court's judgment. A petition for rehearing filed by the appellees was denied.
Issue
The legal question is whether the transportation of motion picture films from distribution exchanges within Utah to local exhibitors, and between exhibitors, constitutes intrastate commerce subject to state regulation, or if it is an integral part of a continuous interstate transportation stream.
Holding
The appellate court reversed the trial court's decision, holding that the entire transportation of films from national distributors, through Utah exchanges, to local exhibitors, and back, constituted continuous interstate commerce, not subject to Utah's intrastate jurisdiction.
Rule
Goods remain in interstate commerce if there is a continuing intent for them to be transported to a final destination, even if there is a temporary stoppage en route for processing or allocation. A halt is considered a convenient intermediate step if the goods are still destined for their final points.
